What you can expect from us. What we expect from you.

These Terms of Service (“Terms”) form an agreement between you and Gabe(“Gabe,” “we,” “us”) governing your use of the Gabe service, including our website, application, and APIs (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

Gabe provides a business-management platform for solo and small service businesses. The Service may include a generated website, a custom CRM, AI-assisted summaries, contact extraction from integrated mailboxes, marketing plan generation, voice-memo capture, and related features. We may add, modify, or remove features at any time.

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at [contact@yourdomain] if you believe your account has been compromised.

You agree to provide accurate information when you sign up and to keep it current.

You agree not to:

• Use the Service to violate any applicable law or the rights of any third party
• Upload or transmit any content that is unlawful, harmful, harassing, defamatory, or otherwise objectionable
• Send unsolicited bulk email, spam, or messages that violate any anti-spam or anti-solicitation laws
• Attempt to reverse-engineer, decompile, or extract source code from the Service, except to the extent expressly permitted by applicable law
• Probe, scan, or test the vulnerability of the Service or its infrastructure without our prior written permission
• Interfere with or disrupt the Service or the servers and networks connected to it
• Use the Service to develop a competing product or to train machine-learning models that compete with Gabe's features
• Misrepresent your affiliation with any person or entity, or impersonate another user

We may suspend or terminate your account for any violation of these acceptable-use rules.

Paid plans are billed in advance on a recurring basis through Stripe. Prices are shown in the app at the time of purchase. By starting a paid subscription, you authorize us (via Stripe) to charge your payment method for the recurring fee until you cancel.

You can cancel your subscription at any time from the Billing page. Cancellation stops future renewals; you continue to have access until the end of the current billing period.

Unless required by applicable law, fees already paid are non-refundable. We may, at our discretion, offer prorated refunds in exceptional cases.

You retain all rights to the data you put into Gabe — your customer records, your notes, your website content, your form submissions, and the email messages we sync from your connected accounts (collectively, “Your Data”). We do not claim ownership of Your Data.

You grant Gabe a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Data solely for the purpose of providing the Service to you.

You are responsible for the legality of Your Data. By uploading it to Gabe, you confirm that you have the right to do so and that doing so does not violate any law or third-party right.

How we collect, use, store, and share Your Data is described in our Privacy Policy.

Some Service features produce text, summaries, and suggestions generated by AI models. AI output is probabilistic and may be inaccurate, incomplete, or otherwise inappropriate for any particular purpose. You are responsible for reviewing AI output before relying on it, especially for any decision involving money, legal commitments, or contact with your customers.

We do not warrant the accuracy, completeness, or fitness of AI-generated output.

The Service integrates with third-party providers including Google (Gmail), Stripe, and others described in our Privacy Policy. Your use of those integrations is also subject to those providers' terms and privacy policies.

Specifically, by connecting your Google account, you agree that Gabe may access your Google data as described in our Privacy Policy and in the consent screen Google presents during the OAuth flow. You can revoke access at any time.

The Service, including its software, design, brand, and content (other than Your Data) is owned by Gabe and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is active and in good standing. We do not grant you any other rights.

From time to time we may offer features labeled as beta, preview, or experimental. These features are provided as-is, may be unstable, may be removed at any time, and are not subject to any service-level commitments.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM LOSS OR CORRUPTION OF DATA.

YOU USE THE SERVICE AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GABE AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR USE OF OR INABILITY TO USE THE SERVICE; (b) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (c) ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold Gabe and its affiliates harmless from any claim, demand, loss, or damages (including reasonable attorneys' fees) arising out of (a) Your Data, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

You may close your account at any time. We may suspend or terminate your account if you violate these Terms, if we are required to do so by law, or if we discontinue the Service.

On termination, your right to use the Service ends. Sections that by their nature should survive termination (including Your Data ownership, intellectual property, disclaimers, limitation of liability, indemnification, and the governing-law section) survive.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and Gabe agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. When we make material changes, we update the “Effective” date and notify you by email or via the app. Continued use of the Service after a change constitutes acceptance of the updated Terms.
